Supreme Court diversity
Mark Tushnet now suggests that not only President Obama appoint another Protestant to the Supreme Court to replace Justice Stevens but to appoint an openly gay one. Is the Supreme Court the right place to exhibit diversity?

ReplyDeleteMy question is not in relation to the possibility of having a gay Protestant justice. By all means, yes. I'm just asking if it is the right direction that the Supreme Court should mirror demographic diversity.

ReplyDeleteA gay Supreme Court Justice would not make half the difference as a gay President. (Lawyers are generally more liberal than the rest of the population). A gay President would be much harder to achieve than an African American was.
