The Next Justice: An Academic?

Yale Law School professor Stephen Carter doesn't think President Obama should nominate an academic:
Professors who have not been judges are often poor justices. Take [William O.] Douglas and [Felix] Frankfurter. Nobody denies their brilliance, but they were iconoclasts, always writing for themselves, never caring if they were able to change the law, as long as their own opinions were pure....In the long run, Douglas and Frankfurter were irrelevant.

  1. I strongly disagree, of course. Having seen how judges act who have a strong dislike of and no knowledge about anything remotely resembling a scholarly argument, I do thing scholars are the better judges.
