As a first-year law professor, I'm still a long time from applying for tenure. But that doesn't mean I'm not thinking about it. Which is why I was interested to read this piece, which discusses--and points to links that discuss--the tenure system. Interesting.

This might be, as often recently, too much from my German viewpoint, but having had experience with non-tenured professors at German grad (business) schools for many years I think very highly of the tenure system. Tenure does guarantee independance. Without it, professors do and write and research what the market demands and the market (i.e.) demands a lotta corporate law but it doesn´t demand the look at details regarding 5th Amendments rights precedents.
